Terms & Conditions
These Terms & Conditions (“Terms”) govern your use of cayonmotors.com (the “Website”) and any purchase, rental or service you obtain from Cayon Motors (“we”, “us”, “our”). By using the Website or transacting with us, you agree to these Terms. If you do not agree, please do not use the Website or our services.
1. Definitions
- “Vehicle” means any car or motor vehicle offered for sale or rental by us.
- “Services” means vehicle sales, vehicle rentals, Sell Your Car facilitation and any related services we provide.
- “You” means the customer, buyer, renter or visitor using the Website or our Services.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to buy, rent or sell a vehicle through us. For rentals, you must also hold a valid driving licence and meet any additional requirements we specify.
3. Your Account
If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. You agree to provide accurate, current information and to notify us of any unauthorised use. We may suspend or close accounts that breach these Terms.
4. Vehicles, Listings & Pricing
- We describe every Vehicle as accurately as possible. Photos, mileage, specifications and availability are provided in good faith but may change without notice.
- Vehicle availability is not guaranteed until an order or booking is confirmed and payment (or a deposit) is received.
- Prices are in Kenya Shillings (KES) and, unless stated otherwise, exclude registration, transfer, insurance, delivery and other statutory costs.
- Pricing errors: if a Vehicle or item is listed at an incorrect price due to a genuine error, we may cancel the order and refund any amount paid, even after confirmation.
5. Orders & Payment
- Placing an order or booking is an offer to buy or rent, which we may accept or decline.
- We accept M-Pesa and other payment methods shown at checkout or agreed with our sales team. Card and mobile-money payments are handled by third-party processors.
- You confirm that any payment details and M-Pesa number you provide are yours and are correct.
- A Vehicle is only reserved for you once the required deposit or full payment is received.
6. Reservations, Returns & Refunds
Reservation deposits, returns, cancellations and refunds are governed by our Return & Refund Policy, which forms part of these Terms. Please read it before transacting.
7. Vehicle Rentals
- Rentals are subject to a separate rental agreement signed at pick-up, which sets out the hire period, mileage limits, insurance, fuel policy and driver obligations.
- You must return the Vehicle in the same condition (fair wear and tear excepted), on time, and with the agreed fuel level.
- You are responsible for traffic fines, penalties, damage and losses arising during your rental period, and for any security deposit deductions as described in our Return & Refund Policy.
8. Sell Your Car
When you submit a Sell Your Car request, you confirm that the information and photos you provide are accurate and that you are the lawful owner (or authorised agent) of the Vehicle. Any agreement for us to buy your Vehicle or sell it on consignment is subject to a separate written agreement, inspection and valuation.
9. Delivery
Delivery timelines, areas and charges are described on our Delivery page and at checkout. Any delivery dates are estimates and not guaranteed. Risk in a Vehicle or item passes to you on delivery or collection.
10. Warranties & “As-Is” Disclaimer
Unless a specific written warranty is provided by us or a manufacturer, used Vehicles are sold “as inspected” and without further warranty. To the fullest extent permitted by law, we disclaim implied warranties beyond those you are entitled to under the Consumer Protection Act, 2012 and other applicable Kenyan law. Any manufacturer warranty is subject to that manufacturer’s terms.
11. Acceptable Use of the Website
You agree not to misuse the Website, including by attempting to gain unauthorised access, introducing malicious code, scraping content, or using it for any unlawful purpose. We may restrict or terminate access for any breach.
12. Intellectual Property
All content on the Website — including the Cayon Motors name, logo, text, graphics and images — is owned by or licensed to us and protected by law. You may not copy, reproduce or use it without our written permission.
13. Third-Party Links & Services
The Website may link to third-party sites and use third-party services (such as payment processors and analytics). We are not responsible for the content, policies or practices of those third parties.
14. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential losses, or for loss of profit, data or opportunity, arising from your use of the Website or Services. Our total liability in connection with any Vehicle, item or Service shall not exceed the amount you paid for it. Nothing in these Terms excludes liability that cannot be excluded under Kenyan law.
15. Indemnity
You agree to indemnify and hold Cayon Motors harmless against any claims, losses or costs arising from your breach of these Terms, your misuse of a Vehicle, or your violation of any law or third-party right.
16. Force Majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, strikes, power or network failures, or acts of government.
17. Privacy
Your personal data is handled in accordance with our Privacy Policy, which forms part of these Terms.
18. Governing Law & Disputes
These Terms are governed by the laws of Kenya. Any dispute shall be subject to the exclusive jurisdiction of the Kenyan courts. We encourage you to contact us first so we can try to resolve any issue amicably.
19. Changes to These Terms
We may update these Terms from time to time. The current version is always posted on this page with a revised “Last updated” date. Continued use of the Website or our Services means you accept the updated Terms.
